A North Carolina State Trooper who was severely injured when his patrol car was struck from behind as he was parked on the side of a highway responding to an earlier vehicle crash has been awarded a $7 million verdict by a federal jury.
The trooper, D.C. Justice, was responding to an earlier crash on eastbound Interstate 40/85 in North Carolina when the bus smashed into his parked Chevrolet Tahoe SUV as he was inside the vehicle on Dec. 24, 2014, according to a story by WRAL TV 5 in Raleigh, N.C.
The trooper was a member of an accident reconstruction team who had responded to the crash of an SUV and a fire engine, the story reported. The trooper’s Tahoe had its blue lights flashing and was blocking a lane to direct traffic away from the crash scene.
As the trooper sat in his vehicle it was struck from behind by a Greyhound bus being driven J.L. Robinson, which sent the trooper’s Tahoe off the shoulder of the highway into some nearby woods, the story continued. The trooper was taken to Duke Regional Hospital with head, neck and arm injuries following the crash.
Passengers on the bus told the news station that the bus driver never appeared to activate the brakes in the bus before the vehicle struck the trooper’s SUV. About 40 passengers were riding on the bus at the time of the crash. Ten passengers were treated at local hospitals for minor injuries.
The bus driver was charged with reckless driving and failure to reduce speed to avoid a collision.
Trooper Justice and his wife, Lisa, filed a lawsuit against Greyhound and the bus driver, seeking damages for his injuries. A federal jury determined that the trooper and the North Carolina Highway Patrol was not negligent in the crash and awarded him $6 for his injuries, according to the story. His wife was awarded $1 million for loss of consortium.
