Car Accident Lawyer Reaches $1.9M Settlement for Severely Hurt Driver Whose Car Was Struck By a DUI Driver

A Connecticut woman who suffered serious injuries in April 2018 when a car being driven by a drunk driver smashed into the side of her car has reached a $1.9 million settlement in the case.
The plaintiff, Loreta Vaichus, 58, of Woodbury, Connecticut, was driving her Toyota Corolla on Spring Road in Middlebury, Connecticut, when her car was struck by a BMW being operated by Christina Robinson, a waitress at The Good News Café, who had just left work, according to a June 11 story by the Connecticut Law Review.
Robinson was driving east on Middlebury Road near the intersection of Spring Road when her BMW entered the westbound lane and smashed into the passenger side of Vaichus’ Toyota, killing Robinson instantly and causing spleen, liver and kidney injuries to Vaichus, the story reported.
Vaichus’ attorney filed a lawsuit in September of 2018 against the restaurant and bar where Robinson worked, alleging negligence due to Robinson being able to drink at the bar after working her shift and then driving home. Vaichus’ attorneys argued that employees should have not been permitted to remain at the business after their shift to drink and become intoxicated, the story continued. Police reports said Robinson had traces of marijuana in her system and a blood alcohol level of 0.16, the story noted. The legal BAC limit in Connecticut is 0.08.
Vaichus’ spleen had to be removed due to the severity of her crash injuries and she also suffered from bleeding of the brain and fractures of her left arm, left wrist, ribs and pelvis, the story reported. The plaintiff missed several months of work as a driving instructor due to her injuries.
The settlement was being paid by Liberty Mutual Group, which was the insurance carrier for the bar and restaurant.
