An Oregon family whose 11-year-old son was killed in April 2012 when he was struck by a city bus in Vancouver, Wash., as he rode his bicycle has reached a $2 million settlement with the bus company.
The boy, Benjamin Fulwiler, died on April 28, 2012 after he collided with the side of a bus and was pulled under it, according to an Aug. 31 story by KPTV Fox 12 News. The boy was riding his bike at 27th Avenue and Main Street in Vancouver when the crash occurred, the story reported.
The driver of the C-Tran city bus, Debra Knox, was later cleared of criminal charges in connection with the crash, the story reported. Knox’s bus was approaching 27th Avenue to make a left-hand turn from Main Street when the collision occurred, the report said. The boy’s arm was severed in the crash and he died hours later at the hospital, according to KPTV.
“In January 2013, police concluded their investigation by saying Knox was driving in ‘a normal fashion’ at the time of the crash and no criminal charges were filed by prosecutors,” the story continued.
The family maintained, however, that the boy “was in the crosswalk at the time of the crash and Knox had an unobstructed view toward him well before impact,” the story reported.
